The TWU Local 591 Executive Board was notified, via Recording Secretary Jorge Rojas, of a complaint from the recent 2022 election in the Southwest Region MLS Section Chairman election regarding a concern over a possible eligibility issue.
According to the allegation, a violation of TWU Local 591 By-Laws, specifically Article X, Section 2, Paragraph B, a Member who was a Member in Good standing with the Local at the time of the nomination did not satisfy the requirement to be continuously in good standing for the preceding twelve (12) months.
“No member shall be eligible for nomination or election to any office unless he/she shall have been in continuous good standing in his/her Local Union for a period of twelve (12) months immediately preceding nomination.”
Upon further investigation, it was determined that Brother David Jimenez was incorrectly permitted to be both nominated and to participate in the election under the provisions in our current Local 591 By-Laws. This investigation also found no evidence that Brother David Jimenez knowingly or willfully violated the election rules as established in our By-Laws. We, the TWU Local 591 Executive Board, would also like to apologize to Brother Jimenez and the Membership for this oversight on our part and any frustration it has caused.
Because this Executive Board has determined that the violation did in fact occur, the Executive Board has determined that, based upon the circumstances surrounding this violation, the proper remedy we determined is re-running the election cycle for that specific position, starting with a new nomination period.
Your Local 591 Executive Board wants to thank the Member for bringing this to our attention, and to also thank all of the Members who previously participated as candidates or voted in the recent elections, and we hope you will continue to be active in the upcoming re-running of this elected position.
In addition, your Local 591 Executive Board owns the responsibility for this administrative oversight, and we are already working to establish safeguards moving forward to ensure that this type of election error does not reoccur.
