LAX MLS Section Chairman Election Update

The TWU Local 591 Executive Board was notified, via Recording Secretary Jorge Rojas, of a complaint from the recent 2022 election in the West Region MLS Section Chairman election regarding a concern over possible election campaign violations.

According to the allegation, a violation of Section 401(g) of the Labor-Management Reporting and Disclosure Act of 1959 prohibits the use of union and employer funds to promote the candidacy of any person in a union election. This prohibition applies to facilities, equipment, supplies, and cash, as well as to campaigning on time paid for by either a union or employer

Upon further investigation, it was determined that Brother Jovante King did on three occasions use company e-mail resources in sending election campaign information.  This investigation also found this action to be unintentional due to his unfamiliarity with Section 401(g) of the Labor-Management Reporting and Disclosure Act of 1959 which prohibits the use of union and employer funds to promote the candidacy of any person in a union election. This prohibition applies to facilities, equipment, supplies, and cash, as well as to campaigning on time paid for by either a union or employer including use of union or employer-owned, leased, or paid for by the union, equipment, such as telephones, fax machines, computers, copy machines, email accounts and vehicles.

Moving forward to make this information more easily available for voters and candidates the election rules, in addition to being posted on the official postings page and bylaws page, will also be included in every election posting moving forward.

We, the TWU Local 591 Executive Board, would also like to apologize to the LAX MLS Membership for this oversight on our part and any frustration it has caused.

Because this Executive Board has determined that the violation did in fact occur, the Executive Board has determined that, based upon the circumstances surrounding this violation, the proper remedy is re-running the online vote with the existing candidates for that specific position.

Your Local 591 Executive Board wants to thank the Member for bringing this to our attention, and to also thank all of the Members who previously participated as candidates or voted in the recent elections, and we hope you will continue to be active in the upcoming re-running of this elected position.

In addition, your Local 591 Executive Board owns the responsibility for this administrative oversight, and we are already working to establish safeguards moving forward to ensure that this type of election error does not reoccur.
